1. General terms and conditions

Those general terms and conditions are applicable on all purchases en sales transactions done on the site www.jewelsbyhook.be concerning the products proposed on the site and all orders placed after receiving a price offer. By placing an order, you agree to be fully bound on those terms and conditions without reservation.

2. About the seller

H00K has its registered office at Adolf Baeyensstraat 34, 9040 Sint-Amandsberg and is registered under the number 0555.995.783. Its VAT number is BE.0555.995.783. E-mailadres: [email protected]

3. Application

H00K can change the terms of sale alone and on any given time. Changes are only applicable on sales done the day changes were made and since than. Only the terms of sale of H00K are applicable on the agreement and not those of the client.

4. Price offers

Price offers received from [email protected] are valid one month. The client needs to pay within this frame of time if the client wants to order. After delivery of goods the same right of renunication is applicable as mentioned in in these general conditions of sale.

5. Prices

All our prices are 21% VAT included and without transportation costs. Prices and availability of goods can be changed without requiring any advance notification. 

6. Payment methods

You can choose from following payment methods: Bancontact, KBC, Belfius, ING, PayPal and Banktransfer. For none of above mentioned payment methods H00K is charging fees to the buyer.

The payment of the price has to happen on the moment of the purchase, which means before delivery, using above mentioned payment methods.

H00K did its outmost best to optimize safety and confidentiality of the online payment, but is in any way liable for for eventual deft, loss of data or any other damage that the buyer could suffer as a result of the online payment. 

Until fully payment of the buyer, goods delivered to the buyer stay H00K's property.

7. Delivery

Delivery takes place 5 days after receipt of payment for goods in Belgium and can take a bit longer for international shipments. If something is custom made, personalised or has to be made from scratch because it is no longer in stock, delivery can take to 4 weeks, depending on how busy H00K is. Not a single delay in delivery can lead to a breaking of the sale or a compensation in favour of the buyer, except in case of an intentional delay. Mistakes in delivery information given by the buyer are the responsibility of the buyer and can lead to extra costs. Unless explicitly written differently, our prices don't include the transport and delivery of the goods to the buyer, those costs will be mentioned separately. We have the right to deliver partial shipments.

In case of non-delivery of the goods, the eventual paid amount by the buyer for those goods will be paid back, without interest or other compensation. Goods are offered on H00K's webshop while stocks last. If after ordering seems that ordered goods by the buyer are no longer in stock, H00K will notify the buyer of that within 15 calendar days and send out a credit nota, that cancels the order. The buyer will than give its bank account information without delay after H00K notified the buyer, so that in that kind of a case H00K can pay back money paid by the buyer within 15 calendar days after the buyer gave hin account information. H00K can in any way not be made responsible of the buyer doesn't give his bank account information as mentioned above.

The buyer can not in any way have the right or claim to damage compensation that would be caused by the cancellation of the sales agreement because of exhaustion of the stock as mentioned above.

Costs, taxes, customs and import duties as the formal requirements connected with shipments outside Belgium are totally falling within the buyers' responsibility. H00K can never be made responsible for consequences caused by non payment by the buyer of previous costs connected with shipments outside Belgium.

8. Description of the goods

H00K tries to describe the products and other content as accurate as possible, but we don't guarantee they are fully correct or without mistakes. We have the right to make adaptations in our descriptions, correct mistakes or change information at any given time without having to make notify before doing so.

9. Loss and damage due to shipment

H00K can not be made responsible for damage, theft or loss of goods during shipment. We do our outmost best to pack the goods as good and safe as possible. The buyer is bound to check the condition of the delivered goods when they are being handed over by the transportation company. 

If the packaging of the delivered goods is damaged or/and opened, the buyer has to notify this to the transportation company and specify this on the note of dispatch the moment goods are being received. 

Every package can be followed online thanks to a unique tracking code. In case of problems with the reception of the goods, the buyer can contact the transportation company and give them their unique tracking code to receive more information concerning the package.

10. Force majeure

H00K isn't responsible for delays due to incidents happened beyond our normal control. Those include production interruptions, delay on transport, strikes or work interruptions that can affect us as well as our suppliers, even if they are foreseeable. 

11. Renunciation right and returns

The buyer has the right to inform the seller (by e-mail to [email protected] with indication of his bank account) that he renounces his purchase, without having to pay a fine or without any motive within 14 calendar days from the day after the delivery. The buyer has to send the item back within 14 calendar days in perfect and re-saleable condition, unused, undamaged, with all labels if provided and in the original packaging to following address:

Goods that were worn, damaged or repaired can't be taken back. H00K will pay the price back paid by the buyer without (transportation fees), within 30 days after reception of the goods on the bank account given by the buyer. H00K can't be made responsible in any way if the buyer doesn't give a bank account as mentioned above. If the buyer doesn't send the goods back as mentioned above, the seller will not have to pay anything back and the goods will remain property of the buyer. The buyer has the right to pick it up at the seller within 14 calendar days or if the buyer asks for it they can be send back to the buyer with transportation costs at their own expense. The risk of sending it back and the costs to send it back are on the expenses of the buyer.

If you want to exchange your bought goods, than we send you the new article without any extra cost. We do give us the right to refuse exchange if we think the goods have been used, worn, damaged by the buyer or if the reasons are not founded. Sales or products in action can't be exchanged.

12. Complaints

We do our outmost best to describe goods on our webshop www.jewelsbyhook.be the best as possible and use pictures to clarify them. If there would be any typing errors, they are human, involuntary mistakes and no right can be derived from them. Colours on the pictures can slightly differ from reality. This may be partly caused by settings or quality of the buyer's screen, as also the incidence of light. We don't accept exchanges based on color deviation. If the client has hesitations about certain products or wants extra info, he can always contact H00K for more information. We reserve the right to change our prices. We do our outmost best to deliver qualitative goods. H00K can not be held responsible for injuries or other damage caused by our products.  

13. Online settlement of disputes

The EU has set up this website to help for unhappy consumers. You can use this site to make a complaint about products or services bought online, and search for a neutral third party to help solve disputes. In some countries you can press charge against consumers as an entrepreneur. If this is the case in your country, click above banner for the ODR-platform. 15. Warranty

As required by legal provisions there is a statutory warranty for our products. If a product doesn't comply with the agreement the buyer has to notify the seller about it 5 days after delivery. The possible compensation can never be higher than the amount payed / invoiced to the buyer. Usual or normal abrasion, unintentionally or intentionally changes changes made by the buyer to the product, not being able to show an invoice or a valid proof of payment and various negligences are explicit but not limitative exceptions to the above mentioned guarantee system. The buyer is obliged to inform H00K when goods show defects through [email protected] with a clear description of the defects and pictures, this within 5 calendar days starting after delivery of the goods at the buyer. H00K undertakes to deal with the deficiencies in line with the duties imposed by the Belgian law that is applied.

16. Property law

None of the information or pictures from our webshop can be copied or used without our explicit consent.

17. Applicable law

All agreements held with the seller are governed by the Belgian law. The courts of the district of Ghent have exclusive authority.
